1. About Swarmgram, Inc.
Swarmgram, Inc. is a Delaware corporation ("Company," "we," "us," or "our") building AI-powered market research infrastructure. Our primary product, Lewsearch, enables businesses and researchers to run synthetic opinion panel studies calibrated against published survey data. These Terms of Service ("Terms") govern your access to and use of swarmgram.com and any services, APIs, or products provided by Swarmgram, Inc. By accessing any Swarmgram or Lewsearch property, you agree to be bound by these Terms.
2. Products and Services
Swarmgram, Inc. operates Lewsearch (lewsearch.com), an AI market research platform that uses calibrated synthetic agent panels to simulate survey responses across demographic segments. Results are produced by large language models and are intended for directional research, strategic planning, and marketing insight — not as a substitute for probabilistic sampling from live human populations in legal, regulatory, or clinical contexts. Additional products may be offered under the Swarmgram, Inc. umbrella from time to time.
3. Eligibility
You must be at least 18 years of age and have the legal capacity to enter a binding contract to use our services. By creating an account, you represent that all information you provide is accurate, current, and complete. If you are acting on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Accounts and Security
You are responsible for maintaining the security of your account credentials, API keys, and authentication tokens. You agree to notify us immediately at jeffrey@lewsearch.com if you become aware of any unauthorized access. Swarmgram, Inc. is not liable for losses arising from unauthorized access resulting from your failure to maintain credential security. Account credentials may not be shared, transferred, or sold without our prior written consent.
5. Intellectual Property and Proprietary Technology
Swarmgram, Inc. retains all right, title, and interest in and to: (a) the Lewsearch platform and all underlying software; (b) proprietary AI model architecture, model weights, fine-tuned checkpoints, and training methodologies (collectively, the "Lewis Models"); (c) agent simulation infrastructure, belief engine architecture, demographic calibration methods, and memory injection pipelines; (d) benchmark datasets, calibration benchmarks, and methodology documentation; (e) the Swarmgram and Lewsearch names, logos, and associated trademarks. Nothing in these Terms transfers any ownership interest in the foregoing to you.
6. Prohibition on Reverse Engineering
You may not, directly or indirectly: (a) reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, model weights, training data composition, or architectural parameters of any Lewsearch model or service; (b) probe, scan, or test the vulnerability of any Lewsearch system or attempt to circumvent authentication or security controls; (c) scrape, crawl, or systematically extract study results, model outputs, or API responses for the purpose of training competing AI models or replicating our methodology; (d) benchmark our services against third parties for publication without written consent; or (e) use our services in any way that violates applicable law or that competes with Swarmgram, Inc.
7. Customer Data and Output Ownership
You retain ownership of the questions, prompts, and inputs you submit ("Customer Inputs") and the reports and outputs generated for your account ("Customer Outputs"). You grant Swarmgram, Inc. a limited, non-exclusive license to process Customer Inputs solely to provide the services. We will not use Customer Inputs or Customer Outputs to train AI models without your explicit written consent. Aggregate, de-identified benchmark statistics may be used by Swarmgram, Inc. for research and marketing purposes.
8. Acceptable Use
You agree not to use our services to: (a) generate disinformation, fabricated quotes, or content designed to deceive the public about the views of real individuals or groups; (b) manipulate elections or public policy through coordinated synthetic opinion campaigns; (c) produce content that is defamatory, harassing, or that violates any third party's rights; (d) circumvent rate limits, access controls, or usage quotas; (e) present AI-generated synthetic panel results as data collected from live human respondents without appropriate disclosure. Violation of these restrictions may result in immediate account termination without refund.
9. Billing and Subscriptions
Lewsearch subscriptions are billed monthly or annually in advance. Credits included in a plan period do not roll over. Unused credits expire at the end of the billing period. Additional credits may be purchased at rates published on the Lewsearch pricing page. Subscriptions auto-renew and may be cancelled before the next renewal date through your account dashboard. Refunds are considered on a case-by-case basis for charges made within the prior 7 days — contact jeffrey@lewsearch.com with your request.
10. Privacy
Your use of our services is governed by our Privacy Policy, incorporated into these Terms by reference. We collect account information, usage data, and study inputs as described in the Privacy Policy. We do not sell personal data to third parties. Payment processing is handled by Stripe, Inc. under their own privacy terms — we never store payment card data.
11. Data Security
Account data, study results, and agent panel data are stored in Supabase with row-level security ("RLS") policies that enforce per-user data isolation at the database layer. No user can access another user's study results or account data through any application path. Network transmission uses TLS. Supabase infrastructure is hosted on AWS (us-east-1). We implement commercially reasonable security controls, but no system is impenetrable, and we cannot guarantee absolute security.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AI-GENERATED SYNTHETIC PANEL RESULTS ARE STATISTICAL APPROXIMATIONS AND DO NOT REPRESENT GUARANTEED PREDICTIONS OF HUMAN OPINION. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET ANY SPECIFIC ACCURACY THRESHOLD.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWARMGRAM, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) $500 USD OR (B) THE AMOUNTS PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless Swarmgram, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the services; (b) your violation of these Terms; (c) your use of Customer Outputs in violation of applicable law or third-party rights; or (d) your misrepresentation of AI-generated data as human survey data.
15. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your access immediately and without notice if we reasonably believe you have violated these Terms or applicable law. Upon termination, your right to use the services ceases. You may request export of your study data before termination. Sections 5, 6, 7, 12, 13, 14, 15, and 16 survive termination.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict of laws principles. Any dispute arising from or related to these Terms or the services shall be resolved by binding arbitration in Franklin County, Ohio, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information. You waive any right to participate in class-action proceedings against Swarmgram, Inc.
17. Changes to Terms
We may modify these Terms at any time by posting a revised version on this page. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the services after the effective date of any modification constitutes your acceptance of the revised Terms.
